I. AGREEMENT OVERVIEW
THE UNDERSIGNED has purchased a Music package from CALIFORNIA SOUNDS for the specified date (s) listed above.
CALIFORNIA SOUNDS agrees that the presented DJ -TOM CHANDLER- will arrive in a timely manner and execute the event according to the agreed upon standards set up by the UNDERSIGNED CLIENT and CALIFORNIA SOUNDS.
CALIFORNIA SOUNDS will make every effort to perform the event to their typical standard of excellence.
II. PAYMENT AND DEPOSIT
The undersigned acknowledges that the deposit paid on this package is NON-REFUNDABLE if cancelled less that 90 days prior to the event. If the event is cancelled within 90 days of the date of performance, this deposit shall be forfeit. If the event is re-scheduled, CALIFORNIA SOUNDS will try to accommodate the new event date. However, CALIFORNIA SOUNDS can not guarantee availability for the new date. If CALIFORNIA SOUNDS is unable to schedule said event’s changed date, deposit on this package shall be forfeit. If the event is cancelled before the 90 day cut-off the deposit amount can be refunded within 30 days of cancellation.
The undersigned also acknowledges that payment in full on this package must be received -on or before- the event date in the form of cash or check.
**Checks shall be made payable to TOM CHANDLER. Your California Sounds DJ is an independent contractor and all taxes, fees and liability are handled and dealt with by this individual.**
**There shall be a fee of $100 charged on any returned checks**
**Overtime fee of $75 an hour after 12am or after the 6th hour of performed music unless otherwise specified by your DJ**
**If an event is cancelled less than TWO WEEKS prior to the scheduled date, the total event price must be 65% paid by the UNDERSIGNED before or on the originally scheduled date; because typically DJ/event work is not recoverable in this small of a time period.**
** NO DATE IS CONFIRMED UNLESS: CLIENT PROVIDES DEPOSIT CHECK OR PAYPAL PAYMENT FOR DEPOSIT AMOUNT SPECIFIED ($100.00) UNLESS THE DEPOSIT IS WAIVED BY YOUR CALIFORNIA SOUNDS DJ OR OTHER PAYMENT ARRANGEMENTS HAVE BEEN MADE.**
**NO DATE IS CONFIRMED WITHOUT A “BOOK ONLINE FORM” BEING FILLED OUT IN ADDITION TO -OR IN PLACE OF- THIS DOCUMENT. THIS FORM IS OUR E-CALENDAR THAT ALL CALIFORNIA SOUNDS DJS REFERENCE DAILY.**
III. TERMS AND CONDITIONS:
1. It is client’s responsibility to provide CALIFORNIA SOUNDS with a reasonably secure stage area or other area to set up equipment with easy access. Location of DJ setup should be no further than twenty five (25) feet from a 3-prong, grounded, AC electrical outlet. All charges will be discussed in advance.
2. If extensive dance or room lighting is required, then client shall arrange that any lighting will be connected to separate electrical circuits for safety reasons and so that chances of power or circuit failure are reduced. Also a ceiling height of eleven (11) feet is required for truss arch lighting. If fog or bubbles are required by the client, it is agreed that if any guest finds the fog or bubbles to be discomforting, or unsafe the DJ’s liability is limited, and has the option of curtailing the use of these effects for safety and comfort reasons. All lighting besides the typical wedding dance lighting requires a site visit and the assurance of the venue that power failure or reliability is not a concern. Problems and conditions caused by requests “not recommended” by the DJ are the liability of the undersigned client.
3. Client agrees that DJ is not responsible for things that are not within the DJ’s control. Your DJ is not responsible for “Acts of God”, “Wireless Frequency Service or Interference Problems” or any “Power Related/Electrical Issues”. Client agrees that your DJ cannot perform outdoors in the rain or any such dangerous weather conditions. Also, sprinklers or other sources of water that may create a dangerous condition are included as a precautionary measure.
4. DJ reserves the right to stop the performance at the event if any guest is behaving in a manner that puts DJ or others in a position of possible injury (moshing, fighting etc). DJ reserves the right to keep children away from the equipment. Client agrees to assist DJ in keeping problem guests and children away and/or under control. In order to prevent liability resulting from an accidental injury to any individual at the event, DJ service reserves the right to deny any guest access to the sound system, records, compact discs, cassettes tapes, or other equipment owned, leased or rented by DJ. In the event DJ believes an unsafe situation exists, DJ may call upon the client to remedy the situation. DJ may cease operation at his discretion until the situation is resolved.
5. The DJ is not responsible for the behavior of guests, intoxicated individuals, or children that may affect the overall quality/safety of the event. The DJ is simply responsible for conducting himself, his staff and the event in a professional and safe manner throughout. The DJ is not responsible for damages, injuries or liabilities incurred by above mentioned parties.
6. In the extreme case of the death of scheduled DJ, severe injury and/or severe illness on the day of the event; the scheduled DJ would be replaced by a “more-than-competent” member of the California Sounds Staff that has handled prior events of this type.
7. Your DJ responds only to the requests, wishes or directions of the undersigned clients unless authority is delegated to an agreed upon party (i.e. wedding coordinator, event planner, or parental figure).
8. Rented or purchased additional equipment, costumes and/or tuxedos are billed to the client with a -DJ determined fee- for pickup and delivery of said items to the event.
